Biography

Carol Smith's practice is primarily devoted to surety and fidelity, construction, and employment. Her surety work centers on bid, payment, and performance bonds as well appeal and court fiduciary bonds. She reviews and negotiates construction contracts, prosecutes and defends construction law claims, and pursues recovery of losses from responsible parties.

She also has extensive experience in employment law -- investigating claims on behalf of employers as a neutral fact finder, reviewing and advising regarding policies, and defending employers in administrative proceedings and lawsuits.

Carol attended the University of Kansas before graduating from the KU School of Law in 1987. She is admitted to practice in Kansas and Missouri.

She coauthored  the chapter "Bonds-Bid, Performance, Payment" for the Kansas Construction Law Manual published by the Kansas Bar Association and co-authored with Gilliland and Hayes attorney Keith Witten, the Kansas and Missouri chapters in “Fifty States Construction Lien and Bond Law, Aspen Publishing.   She was a contributing author to The Surety’s Indemnity Agreement:  Law and Practice, 2ndEd. and The Contract Bond Surety’s Subrogation Rights, both published by the Tort Trial & Insurance Practice Section of the American Bar Association.  She is an editor of the TIPS (Tort Trial & Insurance Practice Section) Law Journal annual survey of fidelity and surety cases. She has authored and presented papers and seminars at the national and local level on topics including fidelity law, fiduciary bonds, construction bonds, employment and bankruptcy issues.

Carol is a vice-chair of the ABA-TIPS Fidelity and Surety Law Committee, and is an active member of that committee.
